General Terms and Conditions of Business (GTCB)
PART 1: GENERAL PROVISIONS
1. SCOPE OF APPLICATION
1.1. These General Terms and Conditions (GTC) apply to the provision of hotel rooms (“Accommodation Services”) and/or the provision of conference or banquet facilities (“Event Services”), to all other related services and deliveries as well as the culinary services (“Gastro”) and the wellness services (“Spa”) of Dolder Grand resp. Dolder Hotel AG (hereinafter “Dolder Grand”) to customers (hereinafter referred to either as “Organizer” or “Guest”; in the case of provisions that apply to both categories, the term “Customer” shall apply).
1.2. The general provisions of this first part of the GTC shall apply to all services provided by Dolder. For Accommodation Services, Event Services, Gastro and Spa the contractual provisions for the relevant service category shall also apply. In the event of contradictions between the provisions relating to the individual services and these general provisions, the provisions relating to the individual services shall take precedence.
1.3. All offers made by Dolder Grand are based on these GTC. The GTC form an integral part of every contract with Dolder Grand. Dolder Grand reserves the right to amend the GTC at any time. The current version is published on the Dolder Grand website. By using the services of Dolder Grand, the Customer accepts the current GTC. Individual amendments to these GTC require an express written agreement between Dolder Grand and the Customer. This shall also apply to the waiver of the written form requirement. Should these GTC contradict any contractual terms and conditions of the Customer, these GTC shall take precedence.
2. CONCLUSION OF CONTRACT AND PARTIES
2.1. Following the Customer’s reservation, the Customer shall receive a reservation confirmation from Dolder Grand in text form (by e-mail, fax or letter). The contract shall only be concluded upon Dolder Grand’s confirmation of reservation to the Customer.
2.2. A Customer is an Organizer if he (i) organizes events on the premises of Dolder Grand or (ii) makes group bookings of 10 persons or more.
2.3. A Customer is a Guest if it is not the Organizer.
2.4. If a third party has acted on behalf of the Customer, the Customer shall be liable together with the third party as joint and several debtor for all obligations arising from or in connection with Dolder Grand’s services.
3. SERVICES, PAYMENTS AND PRICES
3.1. Dolder Grand shall provide the services ordered or reserved by the Customer and confirmed by Dolder Grand in writing. The Customer shall be obliged to pay Dolder Grand the agreed remuneration for the booked services and the other services used by the Customer. This shall also apply to services and costs that are provided to third parties at the Customer’s request.
3.2. All prices are quoted in Swiss francs (CHF) and include the statutory value added tax (VAT).
3.3. Dolder Grand requires an appropriate down payment. The amount of the down payment and the payment dates shall be agreed in writing in the contract. If the Customer fails to meet its obligation to make a down payment in due time, Dolder Grand shall be entitled to terminate the contract after setting a reasonable grace period. The customer shall be liable to Dolder Grand for any damage resulting from the failure to fulfill the contract.
3.4. All invoiced services provided by Dolder Grand shall be financially covered by a credit card or another method of payment. If no down payment has been agreed or made, the entire invoice amount must be paid in advance or a payment guarantee must be provided at the latest at the time of arrival. In the case of table reservations and consumption in food & beverage outlets, the general rule is that the services purchased must be paid for by the time of departure at the latest. If payment by invoice is agreed, the entire invoice amount is due 30 days after the invoice date. In the event of late payment, Dolder Grand shall be entitled to charge default interest at a rate of 5% p.a., as well as any debt collection costs.
3.5. If the period between reservation and contractually agreed service provision exceeds 12 months, Dolder Grand shall be entitled to unilaterally and without prior notice charge the Customer the prices valid at the time of the service to be purchased.
4. COMPLIANCE WITH DOLDER GRAND’S REGULATIONS / ATTACHMENT OF DECORATION MATERIALS
4.1. Dolder Grand’s regulations, in particular keeping escape routes clear, compliance with the smoking ban, etc., must be observed.
4.2. The attachment of decorative materials and other objects to walls, doors and ceilings shall always require the prior consent of Dolder Grand. The Customer shall be liable for any damage incurred by Dolder Grand as a result. In addition, the Customer shall be responsible for ensuring that the decoration material brought in by the Customer complies with fire regulations and all other applicable legal requirements.
5. W-LAN USE
5.1. Dolder Grand shall provide the Customer with free Internet access via a Wi-Fi network. This service does not include the provision of firewalls or programs to defend against harmful computer programs. The Customer must protect access to his own important or personal data independently. Unknown files should not be opened by the Customer. The Customer may not use Dolder Grand’s Wi-Fi to receive illegal content or make it accessible to other persons. 6. INTELLECTUAL PROPERTY RIGHTS AND RECORDINGS ON THE DOLDER GRAND PREMISES
6.1. All rights to the Dolder Grand, in particular logos, brands, hotel and company names as well as the external appearance of the Dolder Grand and its facilities are the sole property of Dolder Hotel AG. If Customers and their guests take photos, videos, audio and/or visual recordings of any kind during their stay on the Dolder Grand premises, these may only be used for their own private use. In doing so, the personal rights of other persons who are also on the premises (e.g. other customers, visitors or employees of Dolder Grand) must be respected. Such persons may only be recorded if they agree to the recordings in advance. The art on the Dolder Grand premises is protected by copyright. Recordings of art may only be used for your own personal use. The use of recordings for other purposes requires the consent of the respective copyright holder.
6.2. The use of recordings for commercial purposes is prohibited and requires the prior written consent of Dolder Grand. A commercial purpose is anything that is not exclusively for personal use (for example, recordings of brand ambassadors or social media influencers who receive a direct or indirect benefit for their activities are also considered commercial). Photography and filming in connection with events at Dolder Grand are generally permitted in the rented rooms. If recordings are desired in the public areas, Dolder Grand must approve this in advance. 7. DATA PROTECTION

8. LIABILITY
8.1. The Customer shall be liable to the Dolder Grand for all damage and loss or other damage caused by itself, its employees, its agents or its guests. Dolder Grand accepts no liability for theft of or damage to items brought onto the Dolder Grand premises and/or used by the Customer, its employees, its agents or its guests. The insurance of such items shall be the responsibility of the Customer. The Dolder Grand may at any time demand proof of adequate insurance from the customer. The Dolder Grand shall be free to refuse its services until the Customer can provide proof of adequate insurance.
8.2. The Customer shall be obliged to observe peace and order and applicable legal requirements. The Customer undertakes to fully indemnify Dolder Grand against all claims under civil and public law which are asserted against Dolder Grand by authorities or third parties (including event participants, guests or employees and contractual partners of the Customer) due to the Customer’s event or stay, or to pay for all such claims. The indemnification obligation shall also include any legal or court costs incurred by Dolder Grand.
8.3. Dolder Grand shall only be liable for intentional or grossly negligent contractual or non-contractual damage. Any further liability, in particular for slight or medium negligence, is excluded. Dolder Grand shall only be liable for its auxiliary persons or other authorized third parties in the event of intentional or grossly negligent damage and for direct damage. Any further liability, in particular for slight or medium negligence and liability for indirect damage, is excluded. Indirect damages within the meaning of these GTC include in particular loss of profit and pure financial losses.
8.4. Dolder Grand accepts no liability whatsoever for the provision of external services to customers. The contractual provisions of the external service provider shall apply exclusively.
9. WITHDRAWAL FROM THE CONTRACT AND FORCE MAJEURE
9.1 Dolder Grand shall be entitled to withdraw from a contract with the Customer without compensation if there is reasonable cause to believe that the Customer’s stay or event may jeopardize the smooth operation of the business, the safety or the public reputation of Dolder Grand, or violate the provisions of these GTC or other instructions of Dolder Grand. Dolder Grand expressly reserves the right to claim damages from the Customer.
9.2 The Customer’s withdrawal from a contract shall be governed by the cancellation provisions for the relevant service category. The price according to the reservation confirmation (incl. VAT) shall be decisive for the calculation of the cancellation costs of the individual services.
9.3 In the event of a force majeure event, the party affected by the event shall be released from its contractual obligations for the duration of the event without the other party being able to claim compensation. An event of “force majeure” exists in the event of serious, unforeseeable causes for which the party affected by the event is not responsible, which make it impossible for the party affected by the event to fulfill its contractual obligations and which are beyond its control. Events of force majeure may include explosions, natural disasters (such as floods, earthquakes), war, other acts of war, epidemics and pandemics, embargoes and government restrictions (including decrees or other acts of government authorities regarding the restriction of freedom of movement or the restriction of economic activities). Strikes and other work stoppages or the breakdown of means of transportation do not constitute force majeure events.
9.4 The party invoking force majeure shall inform the other party immediately of the occurrence and end of a force majeure event. It is obliged to take all reasonable measures to ensure that it can fulfill the contract despite the existence of the event.
9.5 If the duration of the impossibility of performance due to force majeure cannot be estimated or lasts longer than 24 hours, Dolder Grand shall be entitled, at its discretion, to withdraw from the contract with the Customer either in its entirety or only with regard to individual services. Dolder Grand shall be reimbursed for any expenses incurred up to the time of withdrawal. Dolder Grand shall be entitled to deduct such expenses from the advance payment made.
10. SPECIAL DOMICILE UNDER DEBT ENFORCEMENT LAW IN SWITZERLAND
10.1 Customers domiciled abroad or without a fixed or known domicile hereby declare that they are subject to compulsory enforcement in Switzerland within the meaning of Art. 50 para. 2 of the Swiss Debt Collection and Bankruptcy Act (SchKG). They choose the city of Zurich as special domicile in favor of Dolder Grand for the fulfillment of all liabilities arising from or in connection with the contractual relationship with Dolder Hotel AG. The Customer agrees that any court/enforcement authorities and/or enforcement documents/decrees and decisions with legally binding effect may be served on the Customer at Dolder Grand’s address.
11. SEVERABILITY CLAUSE
11.1 Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions. In such a case, the invalid provision shall be replaced by a similar but valid provision.
12. APPLICABLE LAW AND PLACE OF JURISDICTION
12.1 The contractual relationship with the Customer shall be governed exclusively by Swiss law (excluding the conflict of laws rules of private international law and the Vienna Sales Convention). The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the city of Zurich.
PART 2: ADDITIONAL PROVISIONS FOR ACCOMMODATION SERVICES
13. CONTRACTUAL USE
13.1 The Customer shall check the rooms and their furnishings upon occupancy and to use them with care. Any defects or damage occurring during the stay must be reported to Dolder Grand immediately. The Customer shall be liable for any damage to the furnishings, regardless of whether it was caused by the Customer or by fellow travelers or pets. Missing inventory shall be deemed to have been purchased by the Customer and will be charged to the Customer. Dolder Grand is entitled to charge the corresponding costs to the Customer’s credit card as consumption. The corresponding invoice will be sent to the Customer by e-mail on request.
13.2 If the furnishings in the room or elsewhere in the hotel have been damaged or destroyed by the Customer, the Customer shall be liable for the replacement or complete repair. The same applies to the loss of income from the room at the full rate. Dolder Grand shall be entitled to charge or invoice the Customer’s credit card for the payment of any damage and/or additional cleaning costs incurred, as well as for the loss of income from the room. The corresponding invoice will be sent to the Customer by e-mail upon request.
13.3 The Customer shall be obliged to maintain peace and order. The Customer shall fully indemnify Dolder Grand against all civil and public law claims asserted against Dolder Grand by authorities or third parties (including other guests, employees or contractual partners).
13.4 Dolder Grand shall document all damage or soiling caused by the Customer on the day of departure or within 48 hours after departure, and may send this documentation to the Customer or the Customer’s insurance company by e-mail at any time upon request.
14. ARRIVAL AND DEPARTURE
14.1 Hotel rooms must be ready for occupancy from 3.00 p.m. on the day of arrival and vacated before 12.00 noon on the day of departure. The Customer is not entitled to an earlier availability or a longer stay in the hotel room.
15. CANCELLATION CONDITIONS FOR INDIVIDUAL ROOMS AND PRESIDENTIAL SUITES
15.1. Cancellation of a hotel room reservation must be communicated to Dolder Grand as early as possible and in writing. The following cancellation terms and conditions apply both to the cancellation of bookings and to no-shows and early departures.
15.2. Cancellations of bookings of individual hotel rooms (up to a total of 9 rooms, excluding presidential suites) must be received by Dolder by 3 p.m. (local time) on the day before arrival at the latest. In the event of a later cancellation, the room rate for one night will be charged. For long-stay bookings for stays of more than 10 nights, the cancellation deadline is 7 days. Cancellation fees are set out in writing in the reservation confirmation. In the event of a no-show or early departure, Dolder Grand reserves the right to charge the full amount of the unused nights.
15.3. Cancellation of the booking of one or more Presidential Suites must reach the Dolder Grand at least 3 days prior to arrival. In the event of a cancellation after this deadline, the Customer will be charged cancellation costs as follows (calculation basis is the maximum number of rooms booked on one of the days of stay according to the reservation confirmation; a subsequent reduction in the number of rooms will not be taken into account): from 3 days before arrival: 100% of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation.
16. GROUP BOOKINGS
16.1. Group bookings are bookings of 10 or more rooms. The Customer is obliged to provide Dolder Grand with a definitive guest list no later than 7 days before arrival, which must contain at least the following information:
- First and last names of the Guests
- Arrival time
- Payment instructions/means of payment of the Guests
16.2. If the Customer has booked a room contingent and this is not fully utilized by the registered Guests (or if no Guest list is registered), Dolder Grand is entitled to release the rooms still available in the respective contingent for open sale. This does not release the Customer from the obligation to fulfill his payment obligations in accordance with the cancellation conditions.
16.3. Cancellation of a group booking or even individual rooms of the group booking must reach Dolder Grand at the latest as follows (the basis for calculation is the maximum number of rooms booked on one of the days of stay according to the reservation confirmation; a subsequent reduction in the number of rooms shall not be taken into account):
- 10 to 30 rooms: 60 days before arrival
- 31 to 79 rooms: 90 days before arrival
- 80 to 119 rooms: 120 days before arrival
- 120 rooms or more: 150 days before arrival
16.4. In the event of cancellation of all or part of the group booking after expiry of the above deadlines, the Organizer will be charged cancellation costs as follows (calculation basis is the maximum number of rooms booked on one of the days of stay according to the reservation confirmation; a subsequent reduction in the number of rooms is not taken into account):
10 to 30 rooms:
- 59 to 30 days prior to arrival: 50 % of the total amount of the nights affected by the cancellation according to the reservation confirmation
- from 29 days before arrival: 100 % of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
31 to 79 rooms:
- 89 to 60 days prior to arrival: 50 % of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
- from 59 days before arrival: 100% of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
80 to 119 rooms:
- 119 to 75 days prior to arrival: 50 % of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
- 74 days or more prior to arrival: 100% of the total amount of the nights affected by the cancellation according to the reservation confirmation
from 120 rooms:
- 119 to 90 days prior to arrival: 50% of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
- from 89 days before arrival: 100 % of the total amount of the overnight stays affected by the cancellation according to the reservation confirmation
16.5. Dolder Grand may reduce the cancellation costs at its own discretion, provided that Dolder Grand can re-let the rooms at least at the same price.
16.6. For all cancellations, services provided in advance by Dolder Grand and its partners must be paid in full in all cases.
17. REBOOKING BY THE DOLDER GRAND
17.1. If Dolder Grand is unable to provide the Customer with one or more booked rooms for any reason, the Customer will be provided with an equivalent room if possible. If no equivalent room is available, the Dolder Grand shall provide the Customer with an available room of a different category.
PART 3: ADDITIONAL PROVISIONS FOR EVENT SERVICES
18. CONTRACTUAL USE
18.1. The Organizer shall check the premises booked and used by it before taking them over and to use them with care. Any defects or damage occurring during the period of use must be reported to Dolder Grand immediately. The Organizer shall be liable for damages, regardless of whether they were caused by him or by his event participants. Missing inventory shall be deemed to have been acquired by the Organizer and shall be invoiced to the Organizer. Dolder Grand shall be entitled to charge the corresponding costs as consumption to the Organizer’s credit card. The corresponding invoice will be sent to the Organizer by e-mail upon request.
18.2. Should the equipment in the event rooms or elsewhere in the hotel be damaged or destroyed by the Organizer or its event participants, the Organizer shall be liable for the replacement or complete repair. The Organizer shall also be liable for the loss of income from the event premises at the full rate. Dolder Grand shall be entitled to charge or invoice the Organizer’s credit card for the payment of damages incurred and/or additional cleaning expenses, as well as for the loss of income from the event premises. The corresponding invoice will be sent to the Organizer by e-mail upon request.
18.3. The Organizer is obliged to maintain peace and order. The Organizer shall indemnify Dolder Grand in full against all civil and public law claims asserted against Dolder Grand by authorities or third parties (including event participants, guests or employees and contractual partners of the Organizer) on the basis of its event, or to pay for all such claims.
18.4. Dolder Grand shall document all damage and soiling on the day of the end of the event or within 48 hours after its end, and can send this documentation to the Organizer or its insurance company by e-mail upon request.
18.5. Furthermore, the Organizer shall be responsible for ensuring that no more persons are admitted than the capacity of the corresponding room of the venue. The maximum numbers specified by Dolder Grand are binding. In the event of non-compliance, Dolder Grand accepts no liability.
19. ROOM USE / AUTHORIZATIONS
19.1. Dolder Grand reserves the right to make changes to the room. Any subletting or re-letting of rooms or areas by the Organizer shall require the prior written consent of Dolder Grand.
19.2. Unless otherwise stipulated in the contract, the Organizer shall obtain any necessary permits himself and at his own expense. Copyright compensation in connection with music performances must be registered and paid by the Organizer.
20. NUMBER OF PARTICIPANTS AT EVENTS
20.1. The Organizer shall inform Dolder Grand of the final number of participants (hereinafter “confirmed number of persons”) as early as possible. The date of the event shall be the start of the event, in the case of events lasting several days the first day.
- Subject to the cancellation provisions pursuant to Clause 24 below (complete cancellation of the event), a reduction in the number of persons for events with a confirmed number of persons of up to 149 is possible free of charge as follows: Reduction of the number of persons up to 60 days before the event date by a maximum of 40% of the originally confirmed number of persons.
- Reduction of the number of persons 59 to 30 days before the event date by a maximum of 20% of the originally confirmed number of persons.
- Reduction in the number of persons 29 to 10 days before the event date by a maximum of 10% of the number of persons originally confirmed.
20.2. Subject to the cancellation provisions pursuant to Clause 24 below (complete cancellation of the event), a reduction in the number of persons is possible free of charge for events with a confirmed number of persons of at least 150 as follows:
- Reduction of the number of persons up to 120 days before the event date by a maximum of 40% of the originally confirmed number of persons.
- Reduction of the number of persons 119 to 90 days before the event date by a maximum of 20% of the originally confirmed number of persons.
- Reduction of the number of persons 89 to 10 days before the event date by a maximum of 10% of the originally confirmed number of persons.
20.3. If the actual number of persons is less than the confirmed number of persons (less the above-mentioned free reductions), the confirmed number of persons (less the above-mentioned free reductions) shall be used as the basis for invoicing.
20.4. If the actual number of persons is higher than the confirmed number of persons, the actual costs incurred shall be invoiced. The Organizer also acknowledges and agrees that Dolder Grand has no obligation to accommodate the additional persons.
21. DETAILS OF THE EVENT AND GUARANTEE OF SAFETY
21.1. The Organizer shall inform Dolde Grand transparently about the purpose and nature of the event at the time of booking. Should the Organizer change the purpose and nature of the event, Dolder Grand shall be informed immediately. If Dolder Grand discovers that the Organizer has not informed Dolder Grand correctly about the purpose and nature of the event and that the event could pose a reputational risk for Dolder Grand, Dolder Grand shall be entitled to withdraw from the contract. The Organizer shall be liable to Dolder Grand for any resulting damage.
22. SURCHARGES FOR EVENTS
22.1. From 00.00 a.m. onwards, a night surcharge of CHF 10.00 per Guest (based on the confirmed number of persons) and hour commenced will be charged (minimum CHF 250.00 per hour).
23. CATERING FOR EVENTS
23.1. Unless otherwise agreed in writing, the Organizer is obliged to purchase all food and beverages from Dolder Grand. Otherwise, an agreed-upon tap fee will be charged.
24. CANCELLATION CONDITIONS
24.1. Cancellations of a reservation of event premises must be communicated to the Dolder Grand as early as possible and in writing by the Organizer. Cancellation of the event free of charge is possible within the following period:
- Events with a confirmed number of persons of up to 149 (excluding any reductions free of charge pursuant to Clause 20): up to 120 days before the date of the event
- Events with a confirmed number of persons of at least 150 (excluding any free reductions in accordance with Clause 20): up to 150 days before the date of the event
24.2. In the event of a cancellation after the above-mentioned deadlines, the Organizer will be charged the provision costs and additionally the following cancellation fees of the expected invoice amount (calculated according to the number of participants listed in the reservation confirmation):
24.3. Events with an originally confirmed number of persons up to 149 (excluding any reductions free of charge in accordance with Clause 20):
- 119 to 90 days before the date of the event: payment of 40% of the lost turnover according to the reservation confirmation
- 89 to 60 days before the event date: payment of 60% of the lost turnover according to the reservation confirmation
- 59 to 30 days before the date of the event: payment of 80% of the lost turnover according to the reservation confirmation.
- from 29 days before the date of the event: payment of 100% of the lost turnover according to the reservation confirmation.
24.4. Events with a confirmed number of persons of at least 150 (excl. any free reductions in accordance with Clause 20):
- 149 to 120 days before the date of the event: payment of 40% of the lost turnover according to the reservation confirmation
- 119 to 90 days before the date of the event: payment of 60% of the lost turnover according to the reservation confirmation
- 89 to 60 days before the event date: payment of 80% of the lost turnover according to the reservation confirmation
- from 59 days before the event date: 100% of the lost turnover according to the reservation confirmation
24.5. If the loss of revenue is compensated by customer bookings from third parties for the same period and the same rooms, Dolder Grand may, at its own discretion, refrain from charging the cancellation costs or reduce them.
24.6. For all cancellations it also applies that services provided in advance by Dolder Grand and its partners must be paid in full in all cases.
PART 4: ADDITIONAL PROVISIONS FOR SPAS
25. SPECIAL CONTRACTUAL CONDITIONS
25.1. Special contractual conditions apply to Spa services. By making use of a service, the Customer confirms that he/she is aware of and agrees to these.
25.2. Children aged 12 and over are welcome in the Spa when accompanied by an adult. They can use the swimming pool, the aqua zone with steam bath and sanarium, the workout and group fitness classes and our range of treatments. The minimum age for the Ladies’ Spa and Gentlemen’s Spa is 16 years.
26. CANCELLATION CONDITIONS
26.1. Cancellations of treatments or bookings for the Spa must reach Dolder Grand at least 24 hours before the treatment appointment or before the Spa opens. In the event of cancellation less than 24 hours before the treatment appointment, the Customer is obliged to pay the full amount.
PART 5: ADDITIONAL PROVISIONS FOR CATERING SERVICES
27. PERSONAL RESPONSIBILITY FOR INTOLERANCES
27.1. The Customer is obliged to inform the Dolder Grand staff of any allergies or other intolerances before using a catering service. The consumption of food and beverages is the sole responsibility of the Customer and their additional guests.
28. CANCELLATION CONDITIONS
28.1. Unless otherwise stated in the reservation confirmation, cancellations of reservations for a restaurant or other culinary service must reach Dolder Grand at least 24 hours before the reserved date. In the event of cancellation within 24 hours before the reserved date, the Customer shall be obliged to pay the full amount according to the reservation confirmation. If no amount has been agreed in advance, the Customer is obliged to pay a cancellation fee of CHF 100 per registered Guest.
29. PRICE CHANGES
